1. Agreement to these Terms
These Terms and Conditions (“Terms”) govern your access to and use of ModelMe (“ModelMe”, “we”, “us”, “our”), including our website, AI assessment service, and any related features (together, the “Service”). By creating an account, ticking the acceptance checkbox at registration, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not register for or use the Service.
2. Eligibility and account responsibility
By registering, you confirm that the information you provide is accurate, that you are the person to whom the uploaded photos belong (or that you otherwise have the right to upload them), and that you will keep your login credentials confidential. You are responsible for all activity that occurs under your account, and you agree to notify us if you believe your account has been accessed without your permission.
3. The ModelMe Service
ModelMe provides an AI-based photo assessment tool, together with a private, organized space (“My Photos”) and an additional, separately protected private area (“Private Vault”) for storing your own photos. Users may submit specific photos for an AI-generated assessment (“ModelMe Score”) and accompanying feedback. ModelMe is not a modeling agency, and using the Service does not create an agency, employment, or representation relationship between you and ModelMe.
4. AI assessments and their limitations
Your ModelMe Score and any AI-generated feedback are informational and provided for guidance only. They are not a guarantee of modeling success, agency acceptance, or professional work, and they are not a substitute for the independent judgment of a modeling agency, photographer, or other professional.
Assessments are generated by an artificial intelligence system, not by a human panel or by any modeling agency. AI-generated output can be inaccurate, incomplete, or inconsistent, and reasonable people — including agencies — may reach different conclusions than the AI does. ModelMe does not guarantee the accuracy of any assessment, and no assessment result should be treated as a definitive or final judgment of your modeling potential.
Where we offer feedback on strengths, presentation, posing, camera presence, versatility, or photo readiness, this is intended as practical, general guidance to help you understand and potentially improve your photos and presentation — not as a promise of any particular outcome.
5. Photos and content you upload
You retain ownership of the photos and other content you upload to ModelMe. By uploading content, you grant ModelMe a limited, non-exclusive licence to store, process, and display that content back to you as necessary to operate the Service — including generating derivative versions (such as thumbnails or optimized copies) for the app to function, and processing photos you specifically submit for assessment through our AI assessment system, where you have given the required consent. This licence does not give ModelMe any right to publish, market, or otherwise distribute your photos, and does not give ModelMe ownership of your content.
You confirm that you have the right to upload any content you submit, and that it does not infringe anyone else's rights or violate any applicable law.
6. My Photos, Private Vault, and assessment photos
My Photos and Private Vault are both private to you — neither is publicly visible, and neither is visible to other ModelMe users. Private Vault is an additional, separately protected area for photos you want to keep apart from your normal My Photos library. Photos stored in My Photos or Private Vault are never used for AI assessments. Only photos you deliberately submit into the assessment flow, with the consent that flow requires, are processed as assessment inputs. Assessment photos, once submitted, are handled as their own distinct category, separate from My Photos and Private Vault.
7. Your permissions and responsibilities
You agree to use the Service only for its intended purpose, and not to:
- Upload photos of anyone other than yourself without their knowledge and consent
- Upload content that is unlawful, infringing, or that you do not have the right to share
- Attempt to access another user's account, photos, or assessment data
- Reverse-engineer, scrape, or attempt to extract the underlying AI models, prompts, or scoring logic
- Use the Service to harass, defraud, impersonate, or otherwise mistreat any person
- Interfere with or disrupt the Service's normal operation or security
8. Privacy and data handling
Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms. Please read it carefully.
9. Prohibited use
In addition to Section 7 above, you may not use the Service for any unlawful purpose, to violate any third party's rights, to transmit malicious code, or to attempt unauthorized access to any part of the Service's infrastructure. We may investigate and take appropriate action, including suspending or terminating access, where we reasonably believe these Terms have been violated.
10. Intellectual property
Aside from the content you upload, the Service — including its design, branding, software, and the ModelMe Score methodology — is owned by ModelMe or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, or create derivative works of the Service itself except as necessary to use it as intended.
11. Service availability and changes
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, including specific features, at any time, and we will make reasonable efforts to communicate material changes where practical.
12. Payments and paid assessment credits
ModelMe currently provides a configurable allowance of free assessments. We intend to introduce the option to purchase additional paid assessment credits in the future. No payment is currently required to use the Service's existing features.
13. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, reliability, or fitness for a particular purpose. To the maximum extent permitted by applicable law, ModelMe will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including reliance on any AI assessment result.
14. Suspension and termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or where reasonably necessary to protect the Service, other users, or ModelMe.
15. Changes to these Terms
We may update these Terms from time to time. When we publish a materially revised version, we will update the version number and “Last updated” date above, and — where required — ask existing users to accept the new version before continuing to use the Service. Your acceptance of each version is recorded against your account.
16. Governing law
These Terms are governed by the laws of South Africa.
